General Terms and Conditions (GTC) - Nightingale-Court

1 . General

These terms and conditions apply to contracts for the rental of holiday homes for accommodation as well as all other services and deliveries provided for the customer by the landlord Nachtigallenhof.  Any changes or additional agreements require the consent of the lessor in text form.

2. Rental Item

Nachtigallenhof rents holiday accommodation exclusively for private, short-term accommodation purposes. These may only be used for the booked and confirmed number of guests. Any other use requires the prior consent of the landlord.

Parties, bachelor parties or similar are not allowed in the holiday homes. Rented objects may not be rented to third parties or otherwise made available to third parties for a fee or free of charge.

3. Conclusion of contract

With the booking request, a tenant submits his binding rental request. An inquiry can be made in person, by telephone, by e-mail or via the Nachtigallenhof website or a third party provider. The rental contract for a holiday property comes into effect when the landlord sends the booking confirmation.

4. Rent and Payment

The due date for the down payment and the remaining payment on the agreed rent is determined with the booking confirmation. The deposit is usually due one week after the conclusion of the contract. In the event of late payment, the landlord has the right to withdraw from the rental agreement.

The rental price includes all side costs, Internet access, final cleaning and 7% VAT.


5. Deposit
The landlord charges a one-time deposit of € 250 for the booking period, which must be handed over in cash upon arrival.

 

The deposit amount will be handed over to the tenant after inspection of the apartment in cash or returned within 7 working days.

 

In case of negligently caused damage to the rental property and inventory, in case of violations of the terms and conditions or the house rules, the deposit expires.

 

6. Minimum Rental Period

The minimum length of stay is 5 nights.

​

7. Occupancy Limit

For each holiday home, Nachtigallenhof specifies a maximum number of people as the occupancy limit. The limit may not be crossed without permission from Nachtigallenhof.

​

8. Cancellation Policy

If the tenant cancels, the following cancellation fees apply:

​

        from booking: 20% of the total price

        6 months to 1 month before the arrival date: 50% of the total price

        1 month to 1 week before the arrival date: 80% of the total price

        In the last week before the day of arrival: 90% of the total price

​

The tenant is not released from paying the rent if the tenant has a personal reason - e.g. B. Illness or being prevented from doing so for professional or family reasons - cannot use the holiday home.

​

We recommend that the tenant takes out travel cancellation insurance.

​

If the Münstermaifeld district or our company is officially closed during your travel period due to Corona or an accommodation ban is imposed, your booking will be canceled free of charge. However, if you fall ill with Corona yourself, or have to go into quarantine personally, your district becomes a risk area or you are not allowed to leave the country, this is your responsibility. Please inquire with your travel cancellation insurance whether it will cover costs in the cases mentioned. If you want to cancel a booking for which no ban on accommodation has been announced, our normal cancellation conditions according to the general terms and conditions apply

9. Arrival and departure times, key handover

Booked holiday properties are available to the customer from 4:00 p.m. on the agreed day of arrival. Earlier provision is possible on request.

The keys will be handed over on the day of arrival after prior telephone agreement directly at the holiday home. Outside the regular arrival times (4:00 p.m. to 7:00 p.m.), the customer will be informed where the key for the holiday home is stored. Any questions about the key handover can be clarified in advance by telephone. If the keys are lost, the tenant is liable for the costs incurred as a result.

On the agreed day of departure, the holiday property must be vacated by 10:00 a.m. at the latest and returned to the landlord in a clean swept state.

​

10. Linens, towels

Bed linen and towels are provided by the landlord. The beds are made upon arrival.

​

11. Duty of care, liability of the renter

All holiday properties are non-smoking properties. If guests violate this, the landlord is entitled to charge the tenant a special cleaning fee of €250.00. All rooms are equipped with smoke detectors.

​

We are happy to provide you with ashtrays outside and on the terraces.

​

The tenant must treat the rented premises and the furnishings with care. Culpably caused damage is to be replaced by the tenant. The tenant is obliged to check the facility for completeness and usability when moving into the premises and to report any complaints to the landlord immediately.

 

The tenant must also report any damage occurring during the rental period immediately.

​

12. Pets

Dogs and other pets are welcome guests at the Nachtigallenhof after registration and prior arrangement.

​

Please keep the courtyard area, the nightingale forest and the holiday homes clean and remove any "accidents" that may have occurred if your four-legged companion accidentally does his business on the courtyard area.

​

Animals must be housebroken.

​

The tenant has to ensure that his pet does not disturb the surrounding neighborhood.

​

The tenant is not allowed to leave his pet unattended in the garden or courtyard area or in the holiday home (unless it is in a box).

​

All things that the pet needs are to be brought by the tenant. This also includes your own blanket or basket, possibly a box, and your own towels.

​

Blankets and towels in the house are reserved for our human guests and may not be used for animals.

​

Animals are not allowed to sleep on sofas or in beds.

​

The tenant is fully liable for all damage caused by the pet to the rental property including the property and furnishings.

​

13.  Your stay and special regulations for using the Nachtigallen-Hof

The apartment may only be used by the persons listed in the booking. If the apartment is occupied by more people than agreed, a separate fee must be paid. In this case, the landlord also has the right to terminate the rental agreement without notice.


It is not permitted to sublet or leave the apartment to third parties. The rental agreement may not be passed on to a third party.


The tenant agrees to the general terms and conditions of the Nachtigallen-Hof, as well as the house rules - insofar as such belong to the rental property. The declaration of consent is made with the payment.


In the event of violations of the GTC or the house rules, the landlord is entitled to terminate the tenancy immediately and without notice. There is no legal claim to repayment of the rent or compensation.


The guest undertakes to treat the Nachtigallen-Hof and the entire courtyard with consideration and care.

The guest is aware that staying in a holiday home or holiday apartment in the immediate vicinity of a forest entails particular dangers. These include (but are not limited to): broken branches, slippery damp leaves or on trees, grass and loose stones; the customer will therefore behave prudently according to the environment. Parents have an increased duty of care for their children. Parents are responsible for their children.

​

The use of the BBQ grill or the bread oven is expressly subject to reservation and only by arrangement. The Nachtigallenhof is entitled under certain circumstances (e.g. increased drought and risk of forest fires) to prohibit the use of these.

​

The customer undertakes to behave during quiet times (10 p.m. to 8 a.m.) in such a way that other guests of the Nachtigallenhof are not disturbed in their peace. In the event of violations, the Nachtigallenhof is entitled to exercise its domiciliary rights in the event of repeated violations and to arrange for the customer to leave early. In this case, the rental price will still be charged in full.

In the event of a storm warning from the German Weather Service or similar emergency situations, the Nachtigallenhof is entitled to clear the courtyard for the safety of all guests. The instructions of the employees of the Nachtigallenhof must be followed. If the instructions are not followed, the stay on the farm area and in the holiday homes is at your own risk.

​

Access to the Nachtigallenhof with your own car and to the designated parking spaces is permitted by arrangement.

 

14. Internet/Wi-Fi

If the holiday property is provided with internet/WLAN, the landlord accepts no liability whatsoever for the functionality of the internet/WLAN or for damage resulting from its use, in particular virus infections.

​

Any improper use of the Internet, in particular the use of illegal content from the Internet, for example the illegal use of copyrighted content, is prohibited.

 

​The lessee exempts the lessor from third-party claims against the lessor resulting from improper use.

​

​

15. Withdrawal from the contract by the landlord

If the holiday home is destroyed by fire, storm or a similar event that makes a stay impossible, the landlord is entitled to either offer the tenant an equivalent rental property or to terminate the rental agreement without notice.

 

In the event of overcrowding/double booking, the landlord is entitled to offer the tenant an equivalent replacement rental property without the tenant incurring any additional costs.

​

In the event of a violation of the provisions of these terms and conditions during the stay, the owner is entitled to extraordinary termination of the rental contract without notice. A claim for damages by the tenant is void.

​

16. Choice of Law

German substantive law applies, unless mandatory regulations prescribe the validity of another law.

​

17. Severability Clause

If individual provisions of this contract are ineffective or unenforceable or if they become ineffective or unenforceable after the conclusion of the contract, the remaining parts of the contract remain unaffected by the ineffectiveness.

 

The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions apply accordingly in the event that the contract proves to be incomplete.
